The family of a woman who died along with two others in a crash involving a garbage truck on October 15, 2013, filed suit against the Village of Skokie (Ill.), claiming negligence. According to the family of Gwi Rye Kim, the garbage truck driver was speeding and failed to take evasive action that could have prevented the accident.
Won Suk Lim was driving a 2006 Kia SUV, while Kim and Lim's wife, Jung Ran Min, were passengers in the vehicle when it collided with the garbage truck at the intersection of Harlem and Harrison Street. Fire engulfed the car, which had been crushed by the garbage truck. The driver of the truck was not injured. Dental records were necessary to identify Lim, Min and Kim as their bodies were severely burned in the crash.
Village Claims SUV at Fault
A spokesperson for the Village of Skokie says that the garbage truck had the right of way when it entered the intersection, and that Lim did not stop at a two-way stop sign when he entered the intersection. The lawsuit claims that the garbage truck was exceeding the posted 20 mph speed limit required in a school zone when school is in session. The accident occurred on a weekday at 12:40 p.m. CDT. In addition to the excessive speed, the lawsuit claims that the driver of the garbage truck failed to keep "a proper and sufficient lookout," and that he failed to sound his horn, which could have warned Lim of the impending collision so that he could take evasive measures.
Son Named as Plaintiff
Kim, a native of South Korea who had been in the United States for eight years, was survived by two sons and a daughter. Her oldest son, Jaeyoul Jung, travelled to the United States from South Korea with other family members after hearing of his mother's death. He was named administrator of her estate, and is also named as a plaintiff in the lawsuit.
