The family of a woman who drowned in the Lazy River at Six Flags Hurricane Harbor filed suit against the park, says Frenkel & Frenkel.
The family of a 64-year old mother and grandmother filed suit against Six Flags Hurricane Harbor, alleging that employees failed to act properly, which led to the woman’s death on Sept. 5, 2011. The family of Linda Forbes seeks unspecified damages. “Chaotic and Un-unified” Melinda Forbes and Michelle Trail, daughters of the victim, were at the park with their mother and children. They had just finished riding the Sea Wolf and returned to their table when they heard lifeguards blowing whistles. They saw the staff pulling their mother from the Lazy River, and shielded their children so they would not see their grandmother. Staff members began chest compressions and placed an oxygen mask over Linda Forbes’ face, but did not perform mouth-to-mouth. A park guest, who was an off-duty paramedic, told the staff members to turn the woman on her side. Eventually, an employee brought a defibrillator to the scene, but it failed to operate properly. The sisters said that the scene was chaotic, and that employees were visibly shaken and “not working in a unified manner. Exit Gates Locked When emergency personnel arrived on the scene, they found that the exit gates near the Lazy River, where they needed to enter to get access to Linda Forbes were locked, slowing their progress to the injured woman. The lawsuit, which names the two sisters, also includes Linda Forbes’ sons, Jeffrey and Nelson Scott Forbes, claims that the staff’s lack of training in lifesaving measures, non-operating life-saving equipment and restricted access to the Lazy River, contributed to the premature death of their mother. Emotional Distress The children of Linda Forbes are seeking damages for pain and suffering, emotional distress, and loss of companionship, along with medical and funeral expenses. The sisters claim that the park was negligent and that they have suffered emotional trauma after witnessing their mother’s death.
