Parents File Lawsuit After Death of Child at Daycare Facility
The parents of three-year old Rayne Stanley, who died at the Kidzone Daycare Center in Houston in February, 2013, have filed a lawsuit against the facility, claiming negligence in the child’s death. Rayne, who suffered from severe asthma, died after an asthma attack at the facility. Attack Earlier in Day Reports say that Rayne suffered from chronic asthma and had suffered a small attack earlier in the day. Despite the fact that Rayne suffered an asthma attack earlier in the day, the three-year old was left alone in a bathroom, where she suffered another attack and died. The owner of the daycare claims that Rayne’s parents never informed her how severe Rayne’s asthma was, and says she performed CPR on the child in an attempt to save her, calling the death a “tragic accident.” Not an Accident According to Rayne’s parents and their attorney, the child died as a result of neglect. Rayne’s parents say that when the child had an asthma attack, she could not breathe and they are devastated that their daughter died alone in a bathroom, unable to breathe or open the door to get assistance. The couple’s attorney, Jason Gibson, says that the daycare center was entrusted to care for Rayne, and they failed to do so. Inspection reports from the Texas Department of Family and Protective Services found citations from the previous year indicating that staff at the facility were not certified in first aid. Asthma Statistics According to the Centers for Disease Control (CDC), more than 7 million children suffer from asthma, and over 3,000 people die of the disease every year. Asthma is a lifelong disease that causes chest tightness, coughing and the inability to breathe properly. The CDC also reports that asthma rates are increasing and the disease costs more than $56 million each year.
